Disputes may arise from delay in completion, issues with progress payments and defects in materials or workmanship.
• If you receive a Notice of Intent from a Federal, State or Local Government authority, notifying you of their intention to acquire your property, then it can be a confusing and stressful time. We will ensure that you are properly advised as to the compensation that you are entitled to, whether you are the owner of the property, a tenant of the property or if your business is affected by the compulsory acquisition. It is also important that you understand what compensation you are entitled to and the time limits in which must be adhered, therefore it is important that you contact us as soon as you receive notice of the proposed compulsory acquisistion.
• If you are involved in a dispute with another party or parties, then we can provide you with advice to help you understand your rights and help you to settle the dispute. Once we understand your dispute we can offer advice on the best way to approach the dispute and settle it. If a dispute can be settled by negotiation, then it is the preferable option without the stress and costs involved in litigation. There are various ways to settle a dispute which may involve alternative dispute resolution, such as mediation or arbitration (without the use of the Court), or litigation (Court process). Our objective is to solve the dispute in a fair and reasonable manner taking into account all circumstances, including your personal circumstances. Its only when all the other alternatives have been explored and the other party or parties does not want to settle that we will commence legal proceedings. We have represented clients from Tribunals to the High Court.
